Privacy

Schwartz & Ballen LLP is at the forefront of privacy issues on both the state and federal levels.  In addition to counseling clients on privacy laws, we continually monitor changes to privacy rules and testify before state legislatures and Congress on how proposed privacy legislation may affect financial institutions.  We actively participated in the development of the privacy provisions in the Gramm-Leach-Bliley Act and the Fair and Accurate Credit Transactions Act of 2003 (FACT Act), and have helped shape the manner in which privacy regulations are adopted and implemented by federal and state agencies.

We assist numerous financial institutions with the development of policies and practices that comply with the privacy provisions of Gramm-Leach-Bliley Act and the Fair Credit Reporting Act, as amended by the FACT Act, and we provide guidance in the drafting of privacy statements and notices.  We also advise on the effects of legislation and regulations in such areas as do-not-call procedures, online privacy and anti-spam requirements.
